Introduction / Preamble

I know the uDEV bot has published several threads already on this topic, usually in reaction to specific RSS feeds around Lawsuits and other such areas. I decided to kick off a thread though to discuss this topic, if anyone is interested..


Current Pending Legal Litigations & Impacts & Setting Precedent
We are currently sitting in a Limbo right now. There are several lawsuits now being raised that are attempting to test the validity of AI as a technology (mainly around leveraging copyrighted works in it's training set) . The arguments mainly boil down to:

- Is using copyrighted works for training transformative enough -or- is it copyright infringement?
- Is the generated work that AI produces simply "Collaging" copyrighted works or actually producing a unique piece of transformative work?
- Can AI generated artwork be legally copyrighted in itself, if some human input (prompting / inpainting) exists, or not?

All these ideas are being tested now:

Cases Already Litigated (that give some glimpse into how this will play out)

There is some established precedent we can rely on however, for some additional context on what might happen in the above legal cases.
Below are lawsuits that have already played out.

On the question of 'Is the produced image transformative enough to evade copyright infringement', I would reference the Andy Warhol case:

(This case showed how generous the label 'transformative' and 'fair use' can be in the courts, these edge cases far more extreme than the bar Stability is held at for 'produced imagary')

In this case, he had taken essentially a copyrighted image and brushed in some colors over it (Before and After's are in the link, don't want to dump too much into the thread) - The courts came out pretty strongly in favor of this being considered transformative enough and not copyright infringement, the courts stating they are not in the position to dictate what is artistic transformation or not.

I think this case raises the bar pretty high to attack AI on it's produced works not being transformative enough or just copyright collaging.

The second lawsuit to raise is the case of Google taking copyrighted novel text and publishing online for their e-bookstore service.
In this case Google was deemed fair use and sufficiently transformative in use of the works to not be a copyright infringement.

This was a huge blow to anti-scraping & arguable gives a ton of leeway to use copyright works in a transformative way.. AKA AI learning.
Whether the courts agree is yet to be seen.

On the last case on if AI can be copyrighted or not, even with the limited amount of human interaction.
I think that will be paralleled with photography. All photographs taken belong to the person who owns the camera and took the picture - which can be as simple as a button click.

I don't have any example of case law (yet) but I think this is only a matter of time before that case plays out.

I suspect AI is here to stay... I can't see this court case doing anything meaningful. The way forward as a society will only happen once we let go of the idea that information should be "owned" and used as leverage to exercise "power".

Also, for Stable Diffusion there are a few UI options. I am having a lot of fun with Invoke AI, but for anyone wanting to set it up super fast, Stable Diffusion UI makes a 1-click solution.

With the recent introduction of AI elements in things like Blender, no doubt we will soon be prompting entire games into existence with the need for coding, modelling and texturing a thing of the past... getting to the final product in a much faster, less labour intensive time and method.

Honestly not sure, as it's been like 5 minutes since I used it, so they've probably upgraded like usual. Weird that you find it light on features, since it's the only one I've seen that supports out-painting on unlimited canvas, as well as being much faster to render results in 512x512 than anything else I've tried so far... but I've hardly tried every available option and things change so fast, who knows? xD

All of these might be resolved now.
Oh, it's all good. I think you should give it a try either way, it seems like a lot of features in the works too, like built-in training options right in the UI. The only complaint I have about it was that it seems to take forever if you change the model as it basically has to reload everything so it takes a good minute, but it keeps models cached so you can flip-flop between them fast afterwards.

Other than that, it's one of my favourite UI options to play with... the out-painting canvas is AMAZING. You can take multiple different renders, throw them down on the canvas and it will fill in the blanks and do it's best to build the transitions. For making large landscapes or scenes with multiple characters that don't have totally fucked-up faces, it's really good! :D

One issue I've had with A111 is the inpainting / outpainting UI.
I tried using a Krita / PS Plugin but it feel like a lot of work..

This post might actually win me over to check it out.. I'd probably just use both then but if the outpainting UI is really good.. hmm

What I really want to be able to do is generate an image, then do Img2Img / Inpainting on parts of that image and have it auto upscaled / down scaled / blended back into the image. It's doable in A111 but difficult.

I recently spotted that Microsoft have their own image creator now in the form of Bing Image Creator (god knows why theyd go under the bing brand) which means the larger companies either see value in getting in on this or the risk of dabbling with it is minimal when it comes to law suits. This is one of the pros of heavy hitter companies getting involved in this kind of thing is that it adds an air of legitamacy to the whole idea of AI art

Yeah honestly I don't see the law suits going anywhere as the AI generated work is clearly transformative. Human society will never advance unless people give up the idea of direct ownership of something... like Cadbury trying to copyright the colour purple, and shit like that. Nobody really has their own "style" of anything. Even the artists complaining that their work has been used to train these AI. Their shit isn't original anyway and is a blend of other art forms that have existed for centuries.
